For sizing corporate credit lines, this means tilting more to bad-case scenarios for calculating the earning power of films and other assets used as collateral, rather than more-generous medium performance assumptions used a few years ago. The trend to tighter qualifications means fewer films are financed by banks, though a silver lining is that a less congested film landscape means the movies that make the credit grade have a clearer shot at selling and generating revenue in distribution. "There seems to be a better caliber of movie product today that very often is easier to finance," said Lisa Wolofsky, the Montreal-based manager of gap and international financing in the entertainment unit of National Bank of Canada. "I'm seeing more projects that are viable." One independent segment where bank financing is plentiful is high-end movies. "The pre-sale market is as robust as I've seen in maybe 15 years for films with budgets of $20 million or more," said Jared Underwood, senior VP and group manager of entertainment lending at Comerica. "Films with major stars and directors are selling well. But the lower- to mid-level budget films with smaller stars, tend to be more difficult to pre-sell and riskier in general." Comerica has been a banker to the film, TV and videogame industries for over 20 years, financing over 800 movies. Finance executives say that another effect of fewer pics being funded is lower production costs, particularly because top creative talents have lower salary demands in comparison to the boom years. Another characteristic of the new normal is that a slew of European banks that were significant lenders to the international and Hollywood movie sector have mostly disappeared. Without giving too much away, the tension-filled sequence — during which Ethan Hawke’s life is at risk multiple times — ends with the perfect comedic button from Simon Pegg. The levity was, as Burk explained, something that was not part of the Mission Impossible franchise beforehand but something that director Bird felt passionate about infusing into the fourth installment. The second sequence shown was a high-pace chase scene that occurs during a sandstorm. Audience members cannot see anything except sand granules whipping at them and Tom Cruise, who is forced to chase a baddie using a GPS tracker device only since he cannot see more than six inches in front of him. Oh, and did I mention that part of this chase occurs in vehicles racing at high speeds? The scene ends as the sand storm does — the haze and sand fall away and Cruise is left staring at his target as he speeds away. So yes, if you are going to make a trip to the local IMAX theater this holiday season, maybe consider Mission: Impossible - Ghost Protocol. Jay-Z, Kanye West sued over sample
Soul singer Syl Johnson has filed suit against Kanye West and Jay-Z, alleging that a track on the superstar rappers' hit album "Watch the Throne" infringes on the copyright of his 1967 hit "Different Strokes." Action, filed Oct. 14 in federal court in Illinois, names Universal Music Group, Island Def Jam Music Group and Jay-Z's Roc-A-Fella Records as co-defendants, and seeks an injunction, actual and punitive damages and attorney's fees. According to the suit, the "Watch the Throne" track "The Joy" - originally released as a free download online -- contains an unauthorized sample from "Different Strokes," originally released on the singer's Twilight label. Through his publishing company Syl-Zel, Johnson also controls the copyright of the song, penned by John Cameron and John Zachary. Action claims that Johnson has been paid no royalties from the sale of the West/Jay-Z release, which has sold nearly 1 million copies since its release in August. "Different Strokes" is a cult soul classic that has been sampled by dozens of hip-hop artists, including Public Enemy, N.W.A., Wu-Tang Clan, Boogie Down Production and the Beastie Boys. Michael Jackson even employed a "Strokes" sample on a 1997 dance remix. Johnson's suit claims that West had previously sought to sample the song on his 2010 set "My Beautiful Dark Twisted Fantasy," but clearance could not be secured in time for the release. Johnson - the subject of a massive 2010 boxed set reissue of his '60s work by Chicago's Numero Group - has been involved in several other cases of litigation involving use of his recordings and copyrights by other performers. In June, the Chicago-based singer's appeal of a 2008 decision in a copyright suit filed in 2003 against rap act Cypress Hill involving his 1969 song "Is It Because I'm Black" was dismissed in the same Illinois court. Producer Of The British Office & IT Crowd Sells First U.S. Projects
British TV producer Ash Atalla has sold his first 2 American projects — both comedies — to CBS. They are being produced by CBS TV Studios where Atalla and his company Roughcut TV signed a first-look deal last year. In the UK, Atalla served as a producer on The Office and executive producer on The IT Crowd, both of which were remade in the U.S. by NBC. The formats’ travel to the U.S. put Atalla in contact with U.S. producers, executives and agents and got him thinking about a move across the pond for himself, too. “I thought the world of comedy was getting smaller and smaller, and I found myself knowing more and more about American television,” he said. “I really enjoyed the Americans, liked the longer runs of their shows and through that one day it may be interesting to develop shows directly for the American networks.” Atalla already has experience producing under the U.S. model, which he got to know through his friendship with former Friends executive producer Adam Chase, who created a series for BBC Three, Clone, produced by Atalla and his company. Atalla’s latest comedy series, Trollied at Sky 1, employs a U.S.-style writing staff and recently received a two-season, 26-episode order, which is pretty substantial for the UK where shows usually produce a 6-8-episode season at a time. The lead writers on that show, Nat Saunders and Chris Hayward, are writing one of Atalla’s projects for CBS, an untitled comedy about a guy with OCD. Bringing UK writers to develop directly for the U.S. networks was part of Atalla’s plan. “There is a misconception that the two countries are comedically far apart. That is false,” said Atalla who, along with Saunders and Hayward, recently signed with CAA.
